Welcome to Cupital. These Terms of Use ("Terms") govern your access to and use of the Cupital game and website (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What Cupital is

Cupital is a free, play-money game built around the 2026 World Cup. You receive a starting balance of virtual currency and virtual shares and trade them against a peer-to-peer order book.

No real money is deposited or withdrawn. Balances, shares, and prices have no monetary value.
No prizes of monetary value are awarded. The leaderboard exists for entertainment only; rankings carry no monetary or material reward.
No pay-to-win. Cupital is free to play; no feature can be bought that grants any competitive advantage.
We do not require, request, or permit KYC. This is not a real-money prediction market or a gambling product.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service you confirm that you meet this requirement. We do not knowingly collect data from people under this age.

3. Your account

You are responsible for keeping your login credentials secure and for all activity under your account.
Your username is your single public identifier. Your email address is used for login only and is never shown publicly.
One account per person. Automated or bulk account creation is not permitted.

4. Acceptable use

You agree not to:

attempt to manipulate the market or leaderboard through collusion, multiple accounts, or automated trading;
abuse, harass, or post unlawful content in chat;
interfere with, probe, or attempt to disrupt the Service, its infrastructure, or other users;
reverse-engineer or scrape the Service except as permitted by mandatory law.

We may suspend or terminate accounts that breach these Terms, attempt fraud, or abuse the chat.

Your use of the Service is also governed by our Privacy Policy. When you accept these Terms you also consent to product analytics (PostHog, proxied first-party) and, from a later phase, personalized advertising — both used to keep Cupital free. You can withdraw this consent at any time in your account settings, which will sign you out.

Marketing email is separate and optional. Alongside accepting these Terms you may choose to receive occasional product and feature emails from us. This choice is off by default — leaving it unchecked has no effect on your account or your ability to use the Service. If you opt in, you can opt out at any time from your profile settings or via the unsubscribe link in every marketing email; opting out does not sign you out and does not affect essential, account-related (transactional) emails.

6. Availability and disclaimer

Cupital is a hobby project provided on a best-effort basis with no service-level guarantee. The Service is provided "as is", without warranties of any kind. To the maximum extent permitted by law, we are not liable for any loss arising from your use of the Service, the unavailability of the Service, or the loss of virtual balances.

Nothing on the Service constitutes financial advice or a real prediction market.

7. Changes to these Terms

We may publish new versions of these Terms. When we do, you will be asked to accept the current version the next time you log in, and the previous versions are retained. Continued use after acceptance constitutes agreement to the updated Terms.

8. Governing law and disputes

These Terms are governed by the laws of Germany. We will attempt to resolve any dispute informally first; failing that, the ordinary courts have jurisdiction. We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
